Terms of Membership Service

Updated Terms of Service for Self Made Hub Membership Effective Date: February 10, 2025These Terms of Service ("Agreement") govern your use of the Self Made Hub Membership and All-in-One Platform ("Services"). By subscribing to and using the Services, you agree to the terms and conditions outlined below.

1. Membership Overview

Self Made Hub provides an all-in-one software-as-a-service (SaaS) platform designed to support your business operations, including tools for automations, workflows, landing pages, email marketing, SMS campaigns, and more.

2. Membership Responsibilities

By becoming a member, you agree to:

Timely Payment: Membership fees are charged monthly or annually, depending on your chosen plan. Payments must be made on time to maintain access to the platform.Compliance with Terms: Use the Services in compliance with applicable laws, regulations, and platform-specific policies.Adherence to Marketing Laws: Comply with all applicable email and SMS marketing regulations, including but not limited to:CAN-SPAM Act (U.S.): Ensuring emails are not misleading, include a valid physical address, and provide a clear way to unsubscribe.TCPA (Telephone Consumer Protection Act): Obtaining express consent before sending SMS messages.GDPR (General Data Protection Regulation): Protecting the data privacy of users in the EU and obtaining explicit consent for communication.Anti-Spam Policies: Refrain from sending unsolicited bulk emails or SMS messages that could violate anti-spam laws.Account Security: Maintain the confidentiality of your login credentials and notify us immediately of any unauthorized access.Use of Templates and Intellectual Property: Templates, workflows, and proprietary tools provided by Self Made Hub are the intellectual property (IP) of Self Made Hub. These materials may not be transferred, resold, or redistributed outside of the platform unless you have contracted with us for a custom build.

3. Services Provided

As a Self Made Hub member, you gain access to:

A suite of tools for automation, email and SMS marketing, landing pages, CRM, and more.Support and training resources to assist with platform utilization.24/7 tech support for urgent issues.

4. Intellectual Property and Data Ownership

4.1 Templates, Snapshots, and Proprietary Tools

All templates, workflows, snapshots, and pre-designed materials provided by Self Made Hub (collectively, "Hub Content") are the exclusive property of the company. Members are granted a limited, non-exclusive, non-transferable license to use the Hub Content solely within the platform during the term of their membership. Unauthorized reproduction, distribution, modification, or creation of derivative works from the Hub Content is strictly prohibited.Upon cancellation or transfer to another agency, only the content you have independently created and uploaded to the platform or content that you have contracted with us to custom build will be eligible for export. Transfer requests will be reviewed and granted on a case-by-case basis and may be subject to a processing fee of $500 as outlined below.

4.2 User Data

You retain ownership of any data you upload or generate on the platform (e.g., contact lists, campaign metrics). However, you are responsible for exporting any necessary data before termination of membership, as post-cancellation access is limited.

5. Cancellation and Termination

5.1 Membership Cancellation

You may cancel your membership at any time by providing written notice at least 7 days before your next billing cycle. Upon cancellation, your account will remain active until the end of the current billing cycle.

5.2 Termination by Self Made Hub

We reserve the right to suspend or terminate your account for violations of these terms, misuse of the platform, or failure to pay membership fees.

5.3 Post-Cancellation Access and Data Transfer

Access to the platform and its tools will terminate upon the expiration of your membership. Templates, snapshots, and other proprietary materials provided by Self Made Hub are non-transferable and will remain the property of the company.If you wish to export your independently created content and data or content you have contracted with us to custom build for you upon cancellation, you must submit a written request within 30 days of membership termination. A processing fee of $500 will be charged for this service. Data transfer requests will be processed within 14 business days upon receipt of the request and payment.

5.4 Arbitration for Disputes Related to Cancellation

Any disputes arising from or related to membership cancellation or termination shall be resolved through binding arbitration conducted in Oakland County, Michigan, in accordance with the rules of the American Arbitration Association (AAA) and as stated below in Section 10.  

6. Support and Availability

6.1 Technical Support

Members have access to 24/7 live tech support for urgent issues and regular support during business hours for non-urgent matters.

6.2 Platform Availability

While we strive for 99% uptime, occasional downtime may occur due to maintenance or unforeseen technical issues.

7. Prohibited Activities

As a member, you agree not to:

Use the platform for illegal or unauthorized purposes.Attempt to reverse-engineer, copy, or duplicate any part of the platform or its tools.Share your membership or login credentials with others outside your organization.Send spam or violate email and SMS marketing regulations.

8. Limitation of Liability and Consumer Protections

Self Made Hub will not be held liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the platform, even if we have been advised of the possibility of such damages. Additionally, we disclaim all warranties, express or implied, to the extent permitted by law. Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by applicable consumer protection laws, including but not limited to the Federal Trade Commission Act and the Michigan Consumer Protection Act. If any portion of this limitation of liability is found unenforceable, our liability shall be limited to the maximum extent permitted by law.

Loss of data, revenue, or business opportunities due to platform outages or technical issues.Errors or misconfigurations resulting from user actions.Non-compliance with legal obligations, such as those related to data privacy or marketing regulations.

9. Modifications to Terms

Self Made Hub reserves the right to update or modify these Terms of Service at any time. Members will be notified of significant changes, and continued use of the platform constitutes acceptance of the updated terms.

10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Michigan. Any disputes arising under or in connection with this Agreement shall be resolved through binding arbitration conducted in Oakland County, Michigan, in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator, and the arbitrator's decision shall be final and binding on both parties. Each party shall bear its own costs associated with arbitration, except as otherwise required by applicable law. No class actions or collective arbitrations are permitted under this Agreement. If any portion of this arbitration clause is deemed unenforceable, the remaining portions shall continue in full force and effect.

11. Agreement to Terms

By subscribing to Self Made Hub, you acknowledge and agree to the terms outlined in this Agreement.
